60 χρόνια αποτυχιας στα ανθρώπινα δικαιώματα

Διεθνής Αμνηστία είναι ένα παγκόσμιο ανεξάρτητο κίνημα ανθρώπων που αγωνίζονται για το σεβασμό και την προστασία των διεθνώς αναγνωρισμένων ανθρωπίνων δικαιωμάτων. Έχει πάνω από 2,5 εκατομμύρια μέλη και υποστηρικτές σε πάνω από 150 χώρες και περιοχές.

Οι κυβερνήσεις πρέπει να δώσουν εξηγήσεις και να δράσουν αμέσως

(Λονδίνο) Η Διεθνής Αμνηστία προκαλεί σήμερα τους ηγέτες του κόσμου να δώσουν εξηγήσεις για τις έξι δεκαετίες αποτυχίας στα θέματα ανθρωπίνων δικαιωμάτων και να δεσμευτούν ξανά ώστε να επιτύχουν χειροπιαστές βελτιώσεις.

«Τα σημεία ανάφλεξης για τα ανθρώπινα δικαιώματα στο Νταρφούρ, τη Ζιμπάμπουε, τη Γάζα, το Ιράκ και τη Μυανμάρ απαιτούν άμεση δράση», δήλωσε η Αϊρίν Χαν, Γενική Γραμματέας της Διεθνούς Αμνηστίας, κατά τη διάρκεια της παρουσίασης της Ετήσιας Έκθεσης 2008 της Διεθνούς Αμνηστίας: Η κατάσταση των ανθρωπίνων δικαιωμάτων στον κόσμο.

«Η αδικία, η ανισότητα και η ατιμωρησία είναι τα χαρακτηριστικά γνωρίσματα του κόσμου μας σήμερα. Οι κυβερνήσεις πρέπει να δράσουν αμέσως για να κλείσει η τεράστια ψαλίδα ανάμεσα στις υποσχέσεις και τις πράξεις.»

Η Ετήσια Έκθεση 2008 της Διεθνούς Αμνηστίας καταδεικνύει ότι, εξήντα χρόνια μετά την υιοθέτηση της Οικουμενικής Διακήρυξης των Δικαιωμάτων του Ανθρώπου από τα Ηνωμένα Έθνη, υπάρχουν ακόμα άνθρωποι που πέφτουν θύματα βασανιστηρίων ή κακομεταχείρισης σε τουλάχιστον 81 χώρες, που αντιμετωπίζουν άδικες δίκες σε τουλάχιστον 54 χώρες και που δεν τους επιτρέπεται να μιλούν ελεύθερα σε τουλάχιστον 77 χώρες.

«Το 2007 χαρακτηρίστηκε από την ανικανότητα των δυτικών κυβερνήσεων και την αμφιθυμία ή την απροθυμία των ανερχόμενων δυνάμεων να αντιμετωπίσουν ορισμένες από τις χειρότερες παγκοσμίως καταστάσεις κρίσης ανθρωπίνων δικαιωμάτων, από τις παγιωμένες συρράξεις μέχρι τις αυξανόμενες ανισότητες που κάνουν ουραγούς εκατομμύρια ανθρώπους», πρόσθεσε η κα Χαν.

Η Διεθνής Αμνηστία προειδοποίησε ότι η μεγαλύτερη απειλή για το μέλλον των ανθρωπίνων δικαιωμάτων είναι η απουσία κοινού οράματος και συλλογικής ηγεσίας.

«Το 2008 αποτελεί μια χωρίς προηγούμενο ευκαιρία, για τους καινούργιους ηγέτες που ανεβαίνουν στην εξουσία και για τις χώρες που κάνουν τώρα την εμφάνισή τους στον παγκόσμιο στίβο, να χαράξουν μια καινούργια πορεία και να απορρίψουν τις μυωπικές πολιτικές και πρακτικές, που τα τελευταία χρόνια έχουν κάνει τον κόσμο πιο επικίνδυνο και πιο διχασμένο», συμπλήρωσε η κα Χαν.

Η Διεθνής Αμνηστία προκαλεί τις κυβερνήσεις να δημιουργήσουν ένα καινούργιο πρότυπο συλλογικής ηγεσίας που να βασίζεται στις αρχές της Οικουμενικής Διακήρυξης των Δικαιωμάτων του Ανθρώπου.

«Οι πιο ισχυροί πρέπει να δώσουν το παράδειγμα», είπε η κα Χαν.

· Η Κίνα πρέπει να σταθεί στο ύψος των υποσχέσεων που έδωσε για την Ολυμπιάδα: να επιτρέψει την ελευθερία του λόγου και την ελευθερία του Τύπου και να σταματήσει τη χρήση της «επανεκπαίδευσης μέσω εργασίας».

· Οι ΗΠΑ πρέπει να κλείσουν το κέντρο κράτησης στο Γουαντάναμο και τα μυστικά κρατητήρια, να φέρουν τους κρατούμενους ενώπιον της δικαιοσύνης σε δίκαιες δίκες ή να τους αφήσουν ελεύθερους, καθώς και να απορρίψουν κατηγορηματικά τη χρήση βασανιστηρίων και άλλων μορφών κακομεταχείρισης.

· Η Ρωσία πρέπει να δείξει περισσότερη ανεκτικότητα για τις αντιπολιτευόμενες φωνές και καμία απολύτως για την ατιμωρησία για τις καταπατήσεις ανθρωπίνων δικαιωμάτων στην Τσετσενία.

· Η ΕΕ πρέπει να διερευνήσει τη συνενοχή των κρατών-μελών της στις έκνομες μεταγωγές υπόπτων για τρομοκρατία και να βάλει στα κράτη-μέλη τον ίδιο πήχη για τα ανθρώπινα δικαιώματα που βάζει στις άλλες χώρες.

"Αν θέλει η ελληνική κυβέρνηση να αποδείξει τη δέσμευσή της στην Οικουμενική Διακήρυξη θα πρέπει να κάνει ειλικρινείς και χειροπιαστές ενέργειες στην αντιμετώπιση των μεγάλων ζητημάτων των ανθρωπίνων δικαιωμάτων που απασχολούν τη χώρα μας, όπως η προστασία των προσφύγων και των μεταναστών, η αντίρρηση συνείδησης, η εμπορία γυναικών και η ανοχή στις έκνομες μεταγωγές των ΗΠΑ." δήλωσε ο Σίμος Μπούρας, Πρόεδρος του ελληνικού τμήματος της Διεθνούς Αμνηστίας.

Η κα Χαν προειδοποίησε: «Οι ηγέτες του κόσμου βρίσκονται σε άρνηση, αλλά η αδράνειά τους κοστίζει πολύ ακριβά. Όπως δείχνουν τα παραδείγματα του Ιράκ και του Αφγανιστάν, τα προβλήματα ανθρωπίνων δικαιωμάτων δεν είναι απομονωμένες τραγωδίες, αλλά λειτουργούν σαν ιοί που μπορούν να μολύνουν και να εξαπλωθούν γρήγορα, βάζοντας όλους μας σε κίνδυνο.»

«Οι σημερινές κυβερνήσεις πρέπει να δείξουν ότι έχουν την ίδια ποιότητα οράματος, θάρρους και αφοσίωσης που οδήγησαν τα Ηνωμένα Έθνη στην υιοθέτηση της Οικουμενικής Διακήρυξης των Δικαιωμάτων του Ανθρώπου πριν από εξήντα χρόνια.»

«Οι άνθρωποι όλο και περισσότερο αξιώνουν δικαιοσύνη, ελευθερία και ισότητα.»

Ορισμένες από τις πιο εντυπωσιακές εικόνες του 2007 ήταν εκείνες των μοναχών στη Μυανμάρ, των δικηγόρων στο Πακιστάν και των ακτιβιστριών στο Ιράν.

«Γεμάτοι οργή και ανυπομονησία, οι άνθρωποι δεν φιμώνονται. Οι ηγέτες τους αγνοούν με δικό τους ρίσκο», είπε η κα Χαν.

1. Η Ετήσια Έκθεση 2008 της Διεθνούς Αμνηστίας είναι η ετήσια παγκόσμια αποτίμηση της παγκόσμιας κατάστασης των ανθρωπίνων δικαιωμάτων από την οργάνωση και φέτος καλύπτει 150 χώρες. Το 2008 είναι η 60η επέτειος της Οικουμενικής Διακήρυξης των Δικαιωμάτων του Ανθρώπου.

2. Η έκθεση φωτίζει τις ακόλουθες τάσεις:

· Ένοπλες ομάδες και κυβερνητικές δυνάμεις στοχεύουν αμάχους χωρίς να τιμωρούνται.

· Η βία κατά των γυναικών παραμένει διάχυτη.

· Τα βασανιστήρια και άλλες μορφές κακομεταχείρισης προωθήθηκαν ως αποδεκτές μέθοδοι συλλογής πληροφοριών.

· Η καταπίεση της αντίθετης γνώμης και οι επιθέσεις κατά δημοσιογράφων και ακτιβιστών συνεχίστηκαν.

· Υπήρξε έλλειμμα προστασίας των προσφύγων, των αιτούντων άσυλο και των μεταναστών.

· Υπήρξε άρνηση των οικονομικών και κοινωνικών δικαιωμάτων.

· Οι επιχειρήσεις απέφυγαν τις ευθύνες τους για τις καταπατήσεις ανθρωπίνων δικαιωμάτων.

3. Η Διεθνής Αμνηστία σημείωσε την πρόοδο των τελευταίων 60 ετών, ιδίως τους νόμους και τους θεσμούς για τα ανθρώπινα δικαιώματα, την αυξανόμενη υποστήριξη για την κατάργηση της θανατικής ποινής, ορισμένες ποινικές διώξεις εγκλημάτων πολέμου και εγκλημάτων κατά της ανθρωπότητας σε διεθνή και εθνικά δικαστήρια.

4. Η Οικουμενική Διακήρυξη των Δικαιωμάτων του Ανθρώπου υιοθετήθηκε από τα Ηνωμένα Έθνη στις 10 Δεκεμβρίου 1948.

5. Η «επανεκπαίδευση μέσω εργασίας» είναι ένα σύστημα τιμωρητικής κράτησης στην Κίνα, που επιβάλλεται από την αστυνομία για διάστημα έως και τεσσάρων ετών χωρίς να απαγγελθεί κατηγορία, χωρίς να διεξαχθεί δίκη και χωρίς να υπάρχει δικαστική επανεξέταση.

ΓΕΓΟΝΟΤΑ ΚΑΙ ΑΡΙΘΜΟΙ

Άρθρο 1

Η υπόσχεση του 1948:

Όλοι οι άνθρωποι γεννιούνται ελεύθεροι και ίσοι στην αξιοπρέπεια και τα δικαιώματα.

Η πραγματικότητα το 2008:

Το πρώτο μισό του 2007 σχεδόν 250 γυναίκες σκοτώθηκαν από βίαιους συζύγους ή μέλη της οικογένειάς τους στην Αίγυπτο και κατά μέσο όρο 2 γυναίκες βιάστηκαν κάθε ώρα.

Άρθρο 3

Η υπόσχεση του 1948:

Κάθε άτομο έχει δικαίωμα στη ζωή, την ελευθερία και την προσωπική του ασφάλεια.

Η πραγματικότητα το 2008:

1.252 άνθρωποι έγινε γνωστό ότι εκτελέστηκαν από τα κράτη τους το 2007 σε 24 χώρες, 104 χώρες ωστόσο ψήφισαν για ένα παγκόσμιο μορατόριουμ της θανατικής ποινής.

ΑΡΘΡΟ 5

Η υπόσχεση του 1948:

Κανείς δεν επιτρέπεται να υποβάλλεται σε βασανιστήρια ούτε σε ποινή ή μεταχείριση σκληρή, απάνθρωπη ή ταπεινωτική.

Η πραγματικότητα το 2008:

Η Διεθνής Αμνηστία κατέγραψε περιπτώσεις βασανιστηρίων και άλλης σκληρής, απάνθρωπης ή ταπεινωτικής μεταχείρισης σε περισσότερες από 81 χώρες το 2007.

ΑΡΘΡΟ 7

Η υπόσχεση του 1948:

Όλοι είναι ίσοι απέναντι στο νόμο και έχουν εξίσου δικαίωμα στην προστασία του νόμου, χωρίς καμιά απολύτως διάκριση.

Η πραγματικότητα το 2008:

Η έκθεση της Διεθνούς Αμνηστίας υπογραμμίζει ότι υπάρχουν τουλάχιστον 23 χώρες με νόμους που κάνουν διακρίσεις κατά των γυναικών, τουλάχιστον 15 με νόμους που κάνουν διακρίσεις κατά των μεταναστών και τουλάχιστον 14 με νόμους που κάνουν διακρίσεις κατά των μειονοτήτων.

ΑΡΘΡΟ 9

Η υπόσχεση του 1948:

Κανείς δεν μπορεί να συλλαμβάνεται, να κρατείται ή να εξορίζεται αυθαίρετα.

Η πραγματικότητα το 2008:

Στο τέλος του 2007, περισσότεροι από 600 άνθρωποι βρίσκονταν υπό κράτηση χωρίς κατηγορία, δίκη ή δικαστική αναθεώρηση της κράτησής τους στη στρατιωτική αεροπορική βάση των ΗΠΑ στο Μπαγκράμ του Αφγανιστάν, και 25.000 βρίσκονταν υπό κράτηση από την Πολυεθνική Δύναμη στο Ιράκ.

ΑΡΘΡΟ 10

Ηυπόσχεσητου 1948:

Καθένας που κατηγορείται για ποινικό αδίκημα έχει δικαίωμα με πλήρη ισότητα, να εκδικάζεται η υπόθεσή του δίκαια και δημόσια από δικαστήριο ανεξάρτητο και αμερόληπτο

Η πραγματικότητα το 2008:

54 χώρες καταγράφηκαν στην Έκθεση της Διεθνούς Αμνηστίας για το 2008 ότι έχουν διεξάγει άδικες δίκες.

ΑΡΘΡΟ 11

Η υπόσχεση του 1948:

Κάθε κατηγορούμενος για ποινικό αδίκημα πρέπει να θεωρείται αθώος, μέχρι να διαπιστωθεί η ενοχή του σύμφωνα με το νόμο.

Η πραγματικότητατο 2008:

Οι αριθμοί της Διεθνούς Αμνηστίας δείχνουν ότι περίπου 800 άνθρωποι έχουν κρατηθεί στο Γουαντάναμο από την αρχή της λειτουργίας του τον Ιανουάριο του 2002, περίπου 270 ακόμη κρατούνται εκεί το 2008 χωρίς να τους έχει απαγγελθεί κατηγορία ή να έχουν κινηθεί οι απαιτούμενες νομικές διαδικασίες.

ΑΡΘΡΟ 13

Η υπόσχεση του 1948:

Καθένας έχει το δικαίωμα να κυκλοφορεί ελεύθερα και να εκλέγει τον τόπο διαμονής του στο εσωτερικό ενός κράτους.

Η πραγματικότητα το 2008:

Το 2007, υπήρχαν πάνω από 550 ισραηλινά στρατιωτικά σημεία ελέγχου και μπλόκα που απαγόρευαν ή εμπόδιζαν την κίνηση των Παλαιστινίων μεταξύ πόλεων και χωριών της Δυτικής Όχθης.

ΑΡΘΡΟ 18

Η υπόσχεση του 1948:

Κάθε άτομο έχει το δικαίωμα της ελευθερίας της σκέψης, της συνείδησης και της θρησκείας.

Η πραγματικότητα το 2008:

Η Διεθνής Αμνηστία έχει καταγράψει ότι 45 χώρες έχουν κρατούμενους συνείδησης.

ΑΡΘΡΟ 19

Η υπόσχεση του 1948:

Καθένας έχει το δικαίωμα της ελευθερίας της γνώμης και της έκφρασης και το δικαίωμα να αναζητά, να παίρνει και να διαδίδει πληροφορίες και ιδέες, με οποιοδήποτε μέσο έκφρασης και από όλο τον κόσμο.

Η πραγματικότητα το 2008:

77 χώρες απαγόρευαν την ελευθερία της έκφρασης και του τύπου σύμφωνα με την Έκθεση της Διεθνούς Αμνηστίας για το 2008.

ΑΡΘΡΟ 20

Η υπόσχεση του 1948:

Καθένας έχει το δικαίωμα να συνέρχεται και να συνεταιρίζεται ελεύθερα και για ειρηνικούς σκοπούς.

Η πραγματικότητα το 2008:

Χιλιάδες άνθρωποι πιστεύεται ότι έχουν συλληφθεί κατά τη διάρκεια καταστολής διαδηλώσεων στη Μυανμάρ το 2007, η Διεθνής Αμνηστία εκτιμά ότι περίπου 700 συνεχίζουν να κρατούνται.

ΑΡΘΡΟ 23

Η υπόσχεση του 1948:

Καθένας έχει το δικαίωμα να εργάζεται και να επιλέγει το επάγγελμά του, να έχει δίκαιες και ικανοποιητικές συνθήκες εργασίας και να ιδρύει και να συμμετέχει σε συνδικάτα.

Η πραγματικότητα το 2008:

Τουλάχιστον 39 συνδικαλιστές σκοτώθηκαν στην Κολομβία το 2007, 22 σκοτώθηκαν τους 4 πρώτους μήνες αυτού του έτους.

ΑΡΘΡΟ 25

Η υπόσχεση του1948:

Καθένας έχει το δικαίωμα σε ένα βιοτικό επίπεδο ικανό να εξασφαλίσει την υγεία και την ευημερία του ειδικά οι μητέρες και τα παιδιά.

Η πραγματικότητα το 2008:

Το 14% του πληθυσμού του Μαλάουι ζούσε με HIV/AIDS to 2007, μόνο το 3% από αυτούς είχε πρόσβαση σε δωρεάν φάρμακα κατά του ιού, 1 εκατομμύριο παιδιά έμειναν ορφανά εκεί εξαιτίας θανάτων που σχετίζονταν με το AIDS.

Dissent/mobilisation suppressed

Bangladesh
Prisoner of conscience Jahangir Alam Akash, a journalist and local head of two human rights organizations, was arrested on 24 October 2007 by RAB agents in the north-western city of Rajshahi. He was reportedly given electric shocks, beaten on the soles of his feet with a stick, and hung from the ceiling with his hands tied. He was transferred to the Rajshahi Jail hospital with multiple injuries. His detention followed his television news report in May about the shooting of an unarmed man by RAB agents. He was charged with extortion, a charge widely believed to be false and politically motivated, and held in detention for over a month before being released on bail.

Brazil

In January 2007, Kuretê Lopes, a 69-year-old Guarani-Kaiowá Indigenous woman, died when she was shot in the chest by a private security guard during an eviction from farmlands that the Guarani-Kaiowá occupied as they claim them as their ancestral lands. In September, four Guarani-Kaiowá leaders involved in the occupation were sentenced by state courts to 17 years in prison for the alleged theft of a tractor, a sentence seen by local NGOs as disproportionate, discriminatory and politically motivated. An appeal was pending at the end of the year.

Egypt

In February 2007, Karim Amer became the first blogger in Egypt to be jailed for the peaceful expression of his political views. His four-year sentence was confirmed

on appeal in March. He is a prisoner of conscience. Charges against him included “spreading information disruptive of public order and damaging to the country’s reputation”, “incitement to hate Islam” and “defaming the President.

Kenya

On 7 September 2007, Flora Igoki Tera, a parliamentarycandidate in Meru district, Central Kenya, wasattacked by a gang of three armed men. She wasbeaten, forced to swallow human faeces and warnedto keep out of politics. Police stated thatinvestigations were ongoing but no one had beenprosecuted by the end of the year.

Turkey

Journalist and human rights defender Hrant Dink was shot dead on 19 January 2007. He had previously been prosecuted under Article 301 of the Turkish Penal Code that criminalizes “denigrating Turkishness”. The suspected gunman allegedly stated that he shot Hrant Dink because he “denigrated Turkishness”. An estimated 100,000 people attended Hrant Dink’s funeral in an unprecedented display of solidarity. While a police investigation into the murder resulted in a number of suspects being brought to trial, the full culpability of the security services was not examined. In October, Hrant Dink’s son, Arat Dink, and Sarkis Seropyan, respectively assistant editor and owner of the Turkish-Armenian weekly Agos, were convicted under Article 301 and each received a one-year suspended sentence.

Migrants and asylum seekers unprotected

Chad
Khadija (not her real name) a 14-year-old girl, fled her village to Aradip Internally Displaced Persons (IDP) site in Dar Sila region, eastern Chad, with her six siblings and her parents. Khadija’s family left when her village was attacked by an armed group which had crossed the border from Darfur region in Sudan in late 2006. On 30 April 2007, Khadija woke early as usual to go and collect firewood outside the camp. Once outside she was caught and raped by several armed men. Khadija’s mother explained to AI what happened to her daughter after that: "They used her, they used her horribly, and she was bleeding badly when she was brought back here... A hunter found her lying in the woods and brought her home. She had thorns from the bush all over and lots of cuts. She was also bleeding down there; she was very bad for two days. I just washed her with hot water." Khadija’s story is also that of thousands of Chadian displaced girls and women who face daily danger from attacks. They need immediate and effective protection.

Mexico
In April 2007, migrants’ rights defender Santiago Rafael Cruz was beaten to death in the office of the farm labour organizing committee (Foro Laboral del Obrero Campesino, FLOC), in Monterrey, Nuevo León state. When his body was found, his hands and feet had been tied, and he had been severely beaten on his head and face. Nothing had been stolen from the office. The state authorities denied the killing was linked to his human rights work, but local human rights organizations expressed concern about the thoroughness of the investigation into his death. One person was charged with the murder and detained pending trial at the end of the year. FLOC works to protect the human rights of Mexican migrants who go to the USA as seasonal farm workers.

Morocco/Western Sahara
On the night of 30/31 July 2007, two Senegalese migrants, Aboubakr Sedjou and Siradjo Kébé, were killed and three others were wounded by police near Laayoune in Western Sahara. They were among more than 30 migrants who, according to the authorities, were attempting to reach the coast to migrate to the Canary Islands and refused to stop when ordered to do so. The authorities declared that an investigation would be opened into the killings, but its outcome was not known.

Spain
On 9 June 2007, Nigerian citizen Osamuyia Akpitaye died during an attempt to forcibly deport him. According to witnesses, the two law enforcement officers accompanying him on the flight from Madrid to Lagos tied his feet and hands and gagged his mouth, allegedly with adhesive tape, to counteract his resistance to being deported. Osamuyia Akpitaye died shortly after take-off. An autopsy determined the cause of death as asphyxiation.

Thailand/Laos
AI is concerned for the safety and welfare of over 150 Lao Hmong refugees, including Cho[ng] Lee Lor, To[ng] Her, Ye[ng] Mee Lor. The group, which includes 90 children, are held at the Nong Khai Immigration Detention Center (IDC) in appalling conditions. The refugees were arrested in
Bangkok in 2006, where they had fled from Laos in fear of persecution. In January 2007, a bid to forcibly return the refugees to Laos – in breach of international law – was eventually abandoned following an international outcry. Six months later, after seven refugees escaped from the centre, the authorities restricted the remaining detainees, including children, to their cells for three consecutive months. The refugees subsequently went on hunger strike, as access to water and medical services was limited and personal items reportedly confiscated. Some threatened to commit suicide in protest at their conditions. On 10 April 2008, a representative of the Thai military reportedly visited the group and told them that they would be forcibly returned to Laos. A number of other Lao Hmong groups have been repatriated to Laos, including 11 individuals on 28 February 2008 and 67 on 10 April 2008. They joined some 300 other Lao Hmong returnees, some of whom were forcibly returned.

Torture and ill-treatment

China
Yang Chunlin, a human rights activist from Heilongjiang, was detained on 6 July 2007 for “subversion of state power”. He had supported the legal action brought by over 40,000 farmers whose land had been confiscated without compensation, helping to gather signatures for a petition entitled “We want human rights, not the Olympics”, signed by many of the farmers. Police repeatedly refused him access to his family and lawyer on the grounds that his case “related to the state”. Yang Chunlin was tortured, including on numerous occasions by having his arms and legs stretched and chained to the four corners of an iron bed, and being forced to eat, drink and defecate in that position.

Germany
In August 2007 the Tubingen state prosecutor reopened investigations into allegations that German-born Turkish citizen Murat Kurnaz was tortured and otherwise ill-treated by German Special Forces Command officers while in US custody in Afghanistan in 2002. The reopening of the investigation was prompted by the emergence of three new witnesses. Before his release in 2006,Murat Kurnaz had been detained for a total of four years and nine months, mostly in Guantanamo Bay.

Iraq
In October 2007, the Prisoners’ Association for Justice, an Iraqi human rights NGO, said it had interviewed five children aged between 13 and 17 who had been tortured by Iraqi security forces who suspected them of assisting insurgents and militia.

USA/Afghanistan
Sami al Hajj was a journalist working for al-Jazeera when he and his crew were stopped by the Pakistani police close to the Afghan border. He was transferred from Pakistani custody to American custody, taken to Bagram airbase in Afghanistan, then to prison in Kandahar and ultimately Guantánamo Bay. He described his 16 days in detention at Bagram air base as “the worst in my life”. He says he was physically tortured, had dogs set upon him, was held in a cage in a freezing aircraft hangar and was given insufficient, often frozen food. In Kandahar, he says he was beaten regularly by guards, was by US soldiers, forced to kneel for long periods on concrete floors, had all the hairs on his beard plucked out one by one, and was not allowed to wash for over 100 days. After his transfer to Guantánamo, Sami says that military dogs were used to intimidate him. Guards at the camp shattered his knee cap by stamping on his leg, beat him on the soles of his feet, subjected him to racist abuse and gave him less time for recreation because he is black. Before being allowed to see Sudanese intelligence agents who had come to Guantánamo to interview him, he says that he was shackled and pepper sprayed. He was released on 1 April 2008.

Zimbabwe

On 18 March 2007, Nelson Chamisa, MDC Member of Parliament for Kuwadzana, was attacked with iron bars outside Harare International Airport by people believed to be state security personnel. He suffered a fractured skull, sub-conjunctival haemorrhage (under the lining of the eye) and multiple lacerations of the face. By the end of 2007, no one had been arrested for this assault.

Armed conflict

Central African Republic
In March 2007, Raymond Djasrabaye was one of many villagers in Beboura, Paoua, who were wounded or killed by government forces. Raymond Djasrabaye was shot in the arm, developed gangrene and fled to Chad, where his arm was amputated. His father and mother were also killed.

Colombia
On 23 February 2007, Alba Milena Gómez Quintero and her 18-year-old son Miguel Antonio were killed after being taken from the taxi in which they were travelling by two suspected paramilitaries on the San Juan de Arama-Granada highway, Meta Department, in a spot which lay between two army roadblocks. Alba Milena Gómez had reportedly made an official complaint against the army, which she claimed had falsely accused her of being a guerrilla auxiliary.

Israel/Occupied Palestinian Territories

Zaher Jaber Muhammad al-Majdalawi aged 13 and Ahmad Sabri Suliman ’Ali Abu Zabeidah, aged 14, were killed in an Israeli air strike on 1 June 2007 in Beit Lahiya, in the North of Gaza while flying a kite at the beach. They were among more than 25 unarmed civilians, including several children killed in Israeli air strikes between the second half of May and the beginning of June 2007. Three other teenagers, Maher Hamad Abu Hasheesh (15) and Mohammed (16) and Samir (19) ’Abdul Fattah Abu Mote’e, were killed in an Israeli missile strike while they were grazing their sheep in a field in the North of Gaza City in the morning of 19 May 2007.

In southern Israel, a 32-year-old woman, Shirel Friedman, was killed on the evening of 21 May 2007 when a Palestinian rocket launched from Gaza struck a car in the parking lot of a shopping centre in Sderot. She was one of the two Israeli civilians killed by Palestinian rockets during the year 2007.

Philippines

Siche Bustamante Gandinao, a member of Bayan Muna (People First), a leftist political party, and Misamis Oriental Farmers Association was killed on 10 March 2007. She had testified before the ‘UN Special Rapporteur on extrajudicial, summary or arbitrary executions’ about the murder of her father-in-law, Dalmacio Gandinao, also a member of Bayan Muna. Like her father-in-law, Siche Gandinao campaigned against human rights violations committed by soldiers against residents of their village suspected of being rebels or rebel supporters.

Russia

In Ingushetia, in at least six cases where men were shot dead by law enforcement officers, witnesses claimed that the men had been summarily executed; the authorities stated that they had put up armed resistance. Relatives of a six-year-old boy, shot dead by law enforcement officers during a raid on the family home in November 2007, claimed he had been killed deliberately. Detainees were tortured and ill-treated in order to extract “confessions” or information. At least three people subjected to enforced disappearance or abduction during the year remained missing at the end of the year.

Violence against women

Australia

In December 2007, a District Court described the gang rape of a 10-year-old Indigenous girl as “childish experimentation” and brought the issue of consent inappropriately into the trial. The nine men found guilty were not given custodial sentences.

Cote D’Ivoire
In July 2007, a 16-year-old girl who worked as a maid in a private house was reportedly raped in Abidjan by the son of her employer. The alleged perpetrator was arrested but released the same day. Despite several requests from the lawyer of the victim, by the end of the year no official investigations were known to have taken place.

Hungary

Zsanett E., a 21-year-old woman, was allegedly assaulted by five police officers at the beginning of May 2007 in Budapest. While the case was allegedly initially covered up by police, after Zsanett E reportedly identified her alleged attackers, five officers were taken into preliminary custody, but were released a few weeks later. On 20 May, Prime Minister Ferenc Gyurcsany accepted the resignation of the Minister of Justice and Law Enforcement and the chief of the Police Security Service and dismissed the chief of National Police and the Budapest Police chief. In December, the Budapest Prosecutor’s Office dropped the investigation into the police officers. Zsanett E.’s lawyer appealed against the decision.

Nicaragua
In April 2007, a 24-year-old woman died of complications related to an ectopic pregnancy. A women’s health organization that investigated the case believed that a contributing factor to her death was that life-saving treatment (which Health Ministry regulations explicitly require) was delayed by medical staff because of their concerns over the possibility of being prosecuted for carrying out an abortion.

Saudi Arabia

A 20-year-old woman, known as the “al-Qatif girl” to protect her identity, was gang-raped by seven men in 2006 in al-Qatif city. When the case came to court, she and a male companion who had been with her before the rape were each sentenced to 90 lashes for committing a khilwa offence. The rapists were sentenced to prison terms ranging from one to five years in addition to flogging. All the sentences were then increased on appeal. The rape victim and her male companion were sentenced to six-month prison terms and 200 lashes, while the rapists’ sentences were increased to prison terms ranging from two to nine years in addition to flogging. In December 2007, the King pardoned the rape victim and the case against her and the male companion was reportedly withdrawn.
